Numbers didn't change Thursday after a recount and Logan County commissioners declared Josh Butcher the winner of the county's open circuit judge seat.

Butcher defeated Logan County Circuit Judge Douglas Witten in the May 10 primary by 59 votes out of more than 9,000 votes cast.

Commissioners certified the results Thursday, after the recount, and sent the official numbers to the secretary of state.

Witten had requested a recount of only eight precincts - those in which Butcher generally performed well. Butcher won 20 of 38 precincts.

"As predicted, the recount confirmed the voters' clear choice," said Ryan Donovan, an attorney with Bailey & Glasser, who represents Butcher. "This is the third time Judge Butcher has been declared the winner, and it's time to move on.

"Judge Butcher's opponent certainly has the right to keep fighting, but it won't change the result. And with the whole state facing a budget crisis, the taxpayers shouldn't have to spend another dime," Donovan said.

Witten was appointed by Gov. Earl Ray Tomblin last July to fill the remainder of Roger Perry's term as one of Logan County's two circuit judges. He couldn't be reached Friday for comment.

Butcher served eight years as Perry's law clerk.

This year, for the first time, judicial elections are nonpartisan. Candidates aren't identified by party, and the races are decided in the May primary, rather than in November's general election.
