Oral arguments in former Massey Energy CEO Don Blankenship's appeal have been scheduled for late October, according to a court order released Wednesday afternoon.
The 4th U.S. Circuit Court of Appeals said it will hear the argument on Oct. 26 in Richmond, the order said.
Blankenship is serving a one-year sentence - the maximum allowable under current law - in a California federal prison after being convicted of conspiring to violate mine safety and health standards at Massey's Upper Big Branch Mine, where 29 workers died in an April 2010 explosion.
