A Kanawha County grand jury indicted a Hurricane man accused of spreading sulfuric acid at his ex-girlfriend's home.
Charles Thomas Hatfield, 54, was indicted late last month on charges of attempting to kill or injure by poison and transferring and receiving stolen property.
He is accused of spreading sulfuric acid, also known as battery acid, and other substances, on Robynn Burton's property on Sutherland Drive in St. Albans last year.
He's also accused of selling a ring that was reported stolen by Burton.
Burton allegedly watched Hatfield from a live surveillance feed on her phone and called police.
When officers arrived, they noticed a chemical odor, that the plants and flowers were wet, and that a granular substance was in the front yard and on the front porch. They also saw that the plants and flowers were rapidly deteriorating, according to court documents filed against Hatfield.
Samples of the acid were allegedly found on the vegetation, the air conditioning unit and entry key pad for Burton's garage door.
Also according to a criminal complaint, Hatfield's cell phone records show he sent threatening text messages to another woman about Burton.
"I want her dead lol. I get Joy just thinking about it lol," police wrote that Hatfield allegedly said in a text message.
Hatfield told police he sprayed the acid on the plants to "take care of them" and said he was cleaning the keypad at Burton's residence.
Burton had installed security cameras and obtained a domestic violence protective order after she broke up with Hatfield, according to police. The criminal complaint states that the protective order was not extended, but that Kanawha Family Judge Sharon Mullens had told Hatfield to stay away from Burton.
In December, a judge doubled Hatfield's bail amount after prosecutors said he had tried to make arrangements from jail to hurt Burton.
Hatfield's cell mate contacted police out of fear for Burton. Prosecutors said Hatfield tried to pay his cell mate at South Central Regional Jail to burn down the woman's house and "knock her teeth out," assistant Kanawha prosecutor Maryclaire Akers told Kanawha Circuit Judge James Stucky during a hearing.
Stucky increased his bond to $50,000, or 10 percent cash.
He is set to be arraigned before Stucky at 1:30 p.m. March 18.
In all, Kanawha Prosecuting Attorney Charles Miller announced indictments against 65 defendants late last month.
An indictment is not a finding of fact; it means only that grand jurors have decided that enough evidence exists to warrant a trial. Arraignments are as follows:
